Terms Of Service
By clicking and checking the “I Agree To These Terms” box on this website, you are you are agreeing to the following terms and conditions.
You (the subscriber) understand and agree that you are subscribing to a monthly subscription service, and that the credit card that you are providing to UberMac will be held on file and charged once per month for this service at the rate that you have agreed to. (Currently $35 per month for the HumanShield Monthly Remote Maintenance Package.) Furthermore, you also agree to and understand that you are allowing for and giving permission to UberMac and its technicians to log into, and take over your personal computer so that they can perform the duties included in this subscription package (this will only take place at predetermined times, because your privacy and comfort are of our greatest concern). UberMac will never login to your computer at any time other than the predetermined time, for any reason. Additionally, by agreeing to this Terms Of Service Agreement, you also understand that when you contact UberMac, and need help with other issues, and that you allow or agree to allow UberMac to take over your computer at a time other than when they are performing their monthly maintenance service, this is classified as a separate occurrence that falls under the “Quick Fix” category. Under this separate circumstance, you understand that UberMac will charge the card on file when requesting help or assistance at the following rates: Remote Assistance Connection fee (this includes up to 10 minutes of “Quick Fix” time): $16.50, and $1.65 per minute thereafter. For example: If you call UberMac and request help with an iCloud password issue and we need to connect to your computer, and you agree to this, you have now entered into a “Quick Fix” session, and will be charged $16.50 if your issue is fixed in 10 minutes or less. But if your issue ends up taking us 22 minutes to resolve, we will then charge your card on file for $36.30 total for that session. This is essentially $1.65 per minute. With this agreement, you are agreeing that this is a yearly agreement, although we at UberMac do not believe in contracts, so you are not bound to this subscription in a yearly manner and may cancel at any time by giving us 30 days of notice prior to cancellation. However, you also agree to and understand that UberMac will charge your card for the agreed upon amount, and the agreed upon number of computers / subscriptions requested by you, every month, regardless of weather or not we can log into your computer. We will attempt to contact you for a total of 3 times total within the fist week (7 days) of your scheduled maintenance, by a combination of email, telephone, or other means. If after the third attempt to contact you we still are not able to remotely connect to your computer or reach you, you understand that you will still be charged for that month, but that you are still owed a remote maintenance session by UberMac, and that you may call at anytime to request this session during that month or term, and UberMac will happily honor that request. It is the subscribers responsibility to check their voicemail for the telephone number provided to us, and to also check their email & spam folder for correspondence from us at UberMac. However, we understand issues come up, and we will always be willing to work with you if there was a communication problem. Just call us at 561-623-0533.
Legal Jargon
The undersigned (hereinafter referred to as “you” or “your”) has requested that Cobalt Computer Services Of Florida, LLC, DBA UberMac, (hereinafter referred to as “UberMac”) remotely connect to your computer systems via the internet to assist with resolving a computer system problem. Due to the urgency of your request, UberMac has agreed to attempt to assist you by allowing a member of the UberMac support team to view your desktop and share control of your mouse and keyboard, subject to your execution of this Remote Assistance Permission and Release Agreement (this “Agreement”).
You expressly acknowledge that you have been advised that UberMac’s normal procedure is to require that computer problems be documented by you as they occur to permit UberMac to evaluate them and, if necessary, try to recreate the problem on UberMac’s own computers at its own internal data center under appropriate test conditions. You further expressly acknowledge that there is a possibility that UberMac’s efforts to solve your problems by remotely connecting to your computer systems may result in damage to your computer hardware, software and/or any related systems, including, without limitation, loss of data. Notwithstanding the possibility of such damage, you hereby expressly grant UberMac permission to remotely connect to your computer systems and to record the screen activity during the Remote Assistance session.
In consideration of UberMac deviating from its normal procedures and performing the requested services, you hereby waive and release any and all claims you may have or will ever have against UberMac and its employees, agents, affiliates, officers, and directors relating to or arising out of any damage or loss of any nature whatsoever that results, directly or indirectly, from UberMac remotely connecting to your computer systems as requested by you in this Agreement, as well as the recording of the sessions, including, without limitation, loss of data and damage to your computer hardware, software and/or any related systems.
You agree to defend, indemnify, save and hold harmless, UberMac and its officers, directors, agents, affiliates, and employees from any and all third party claims, demands, liabilities, costs or expenses, including reasonable attorney fees arising from or in any way relating to or arising out of any damage or loss of any nature whatsoever that results, directly or indirectly, from UberMac remotely connecting to your computer systems and/or recording the sessions as requested by you herein.
This Agreement will be governed by the laws of the State of Florida without reference to principles of conflict of laws. Any questions concerning this license should be referred to Cobalt Computer Services Of Florida, LLC, 201 N US Highway 1, Suite E2, Jupiter, FL 33477
